We recently met with a new client who was working three full-time remote jobs for very similar tech companies in software design! He was worried about being sued and wanted advice on how to protect himself. We carefully reviewed each of his employment agreements and found that they contained restrictions preventing him from working with competitors and/or other full-time jobs. Because he was in violation of his employment agreements, he was at risk of facing up to three simultaneous lawsuits.
In the State of Utah, it is legal for an employer to require that employees focus all their time during working hours on their job. Additionally, employers can require employees to get written permission before doing other work which might cause a conflict of interest with their current job. Because of this legal rule, we worked with this client to make changes to his employment situation and to minimize his legal exposure. These changes had numerous benefits for both him and his family.
